
Claims
If you believe that the CBRM has failed to adequately maintain its facilities, roads, trees, or sewers, resulting in bodily injury or property damage, you may submit a claim to the CBRM’s Legal Department for review.
Submitting a claim does not guarantee compensation. You must show that the damage or injury was directly caused by the CBRM’s negligence. Claims that do not meet this requirement will be denied.
Potholes
The CBRM identifies potholes through regular road inspections and reports from the public. If you notice a pothole on a CBRM road, please call 311.
Courts have ruled that municipalities are not responsible for damage caused by potholes. Most potholes are the result of freeze–thaw cycles, and claims for pothole-related damage will be denied.
Fallen Trees and Branch Damage
When reviewing claims related to damage caused by trees, the CBRM considers several factors, including:

Whether the CBRM was aware of the tree’s condition before the incident

If so, whether reasonable inspection and maintenance took place
Damage caused by a CBRM tree does not automatically qualify for compensation. If a tree or branch falls due to a storm or severe weather, the CBRM is not responsible for resulting property damage.
